ISLAMABAD: A Supreme Court bench led by Chief Justice Qazi Faez Isa dismissed a plea challenging the proposed 26th constitutional amendment. The dismissal came after the petitioner’s lawyer, Advocate Hamid Khan, requested to withdraw the case.
The three-member bench also included Justice Naeem Akhtar Afghan and Justice Shahid Bilal Hassan. The petition sought to challenge the proposed changes to the constitution.
During the hearing, Hamid Khan informed the court of his intention to withdraw the petition. “We want to take back the petition,” he said.
Chief Justice Qazi Faez Isa responded sharply, questioning Hamid Khan’s role. “Have you been hired only to withdraw petitions? Abid Zuberi could withdraw the plea himself,” the Chief Justice remarked, referring to the petitioner.
In the exchange, the Chief Justice noted that another petition, related to the same case, had also been filed. “There is another petition along with the objections’ plea,” he said.

“We are taking back both petitions,” Advocate Hamid Khan confirmed.
Chief Justice Isa then addressed Abid Zuberi directly, mentioning another case of his that had not been fixed for hearing. “Mr. Abid Zuberi, I didn’t fix your other case during my tenure,” the Chief Justice said.
Hamid Khan responded, “It will be fixed later.”
The Chief Justice continued, “Do you understand the petition I am talking about?”
“Yes, we have understood,” Abid Zuberi replied.
The withdrawal of the petition brings the case to a close without further debate on the proposed 26th constitutional amendment. The court’s decision reflects the petitioner’s decision to step back from pursuing the legal challenge, leaving the proposed amendment unchallenged for now.
