Citizen Missing Since March Found in Military Custody, IHC Told

The Ministry of Defence has informed the Islamabad High Court (IHC) that Mudassar Khan, missing since March, is in military custody. The report was submitted during a hearing on Friday. Khan, a resident of Muzaffarabad, Azad Jammu and Kashmir, is reportedly facing a trial. However, the ministry did not disclose details of the charges against him.

The revelation came in response to a petition filed by Khan’s wife, Nazima Fatehyab. Justice Mohsin Akhtar Kayani presided over the case, with representatives from the Defence Ministry, the petitioner’s lawyer Imaan Zainab Mazari-Hazir, and the assistant attorney general present in court.

Court Directs Defence Ministry to Allow Family Meeting

During the hearing, the petitioner’s lawyer requested the court to permit Khan’s family to meet him. Justice Kayani directed the Ministry of Defence to facilitate the meeting in accordance with the law. The court adjourned the case to a later date, allowing time for compliance with its orders.

This latest development follows an earlier directive from the court to the Military Intelligence (MI) director-general to submit a sealed report regarding Khan’s whereabouts. The court had taken up the case after the petitioner claimed her husband’s disappearance had been pending with the Missing Persons Commission since August.

Family Claims Custody Confirmed Through Phone Call

The petitioner, Nazima Fatehyab, stated that she received a phone call in November from her missing husband. During the call, Khan allegedly informed her that he was in the custody of an unnamed agency. She urged the court to ensure her husband is produced before an appropriate forum.

The case has raised concerns about the lack of transparency in addressing missing persons’ cases. Human rights activists and legal experts are closely monitoring the proceedings, as it highlights broader issues related to enforced disappearances and due process.

The court’s directive to allow Khan’s family to meet him is being viewed as a positive step. However, questions remain about the charges he faces and the circumstances surrounding his detention. The IHC is expected to review further developments in the coming hearings.
