The Islamabad High Court (IHC) on Thursday questioned the federal government over the possibility of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan facing a military trial. Justice Miangul Hassan Aurangzeb expressed concern over the trial of a civilian in a military court, stating that it was worrisome for both the petitioner and the court.
“Is Imran Khan’s military trial under consideration?” Justice Aurangzeb asked during the hearing of Khan’s petition, which was filed under Article 199 of the Constitution. The petition challenges speculations that the former prime minister may be tried by a military court for his alleged involvement in the May 9 riots, which saw military installations vandalized after Khan’s arrest in a graft case.
The judge referred to statements from government officials, including Defence Minister Khawaja Asif and Law Minister Azam Nazeer Tarar, which have sparked speculation about Khan’s possible military trial. Asif recently told a private news channel that there was growing evidence against Khan, making his military trial more likely.
Justice Aurangzeb emphasized that Khan, as a civilian, should not be tried in a military court. He urged the federal government to clarify its position on the matter, noting that if such a trial were planned, it would have significant legal implications. The court asked the additional attorney general to consult the federal government and provide a clear stance by Monday.
The judge also referred to an anti-terrorism court’s July decision that connected Khan to the May 9 incidents, which had led to widespread unrest. The Pakistan Democratic Movement (PDM) government had initiated military trials for individuals involved in targeting state and military installations during those riots.
Justice Aurangzeb further pointed out that the Supreme Court had already ruled on civilians’ military trials, declaring them null and void in an October 2023 verdict. However, that decision was later suspended by a 5:1 majority ruling in December, pending the court’s final verdict.
The IHC adjourned the case until September 16, awaiting the federal government’s response.
