Local NGOs Demand Dutch Government to Take Action Over Alleged Gaza ‘Genocide’

Pro-Palestinian organizations have filed a lawsuit against the Dutch government, urging an end to arms exports to Israel. The case, filed at The Hague, accuses the Netherlands of failing to prevent what the groups describe as a “genocide” in Gaza. They argue that the Dutch state has a legal obligation under international law to intervene against alleged violations in Gaza and the occupied West Bank.

Calls for Immediate Action

The coalition of Dutch and Palestinian human rights groups is pressing for decisive measures. Their demands include banning the export and transit of weapons, weapon parts, and dual-use items to Israel. They also call for halting Dutch trade and investments that support Israel’s occupation of Palestinian territories.

At the hearing, lawyer Wout Albers criticized the government’s inaction, stating, “The Dutch state is failing to uphold international law. Israel is committing genocide and apartheid using Dutch weapons.”

Legal Challenges

The Dutch government maintains that decisions on arms exports and foreign policy are beyond the court’s jurisdiction. However, the case builds on precedents, such as a ruling earlier this year when the International Court of Justice (ICJ) declared Israel’s occupation of Palestine illegal.

Judge Sonja Hoekstra acknowledged the gravity of the Gaza situation, which is not contested by the Dutch government. However, she emphasized the need to determine the legal responsibilities of the state.

“This case isn’t about political decisions,” Albers argued. “It’s about ensuring respect for international law and protecting fundamental rights.”

Context of the Conflict

The case comes amidst escalating violence in Gaza. Since October 7, 2023, Israeli airstrikes have killed over 44,000 Palestinians and injured more than 100,000. Hamas-led attacks on Israel that day resulted in 1,139 deaths and over 200 hostages.

The International Criminal Court (ICC) has also issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant, accusing them of war crimes. The ICC’s actions reflect growing international scrutiny of the Gaza conflict.

Building on Previous Rulings

This lawsuit follows a February court order that barred the Dutch government from exporting F-35 fighter jet parts to Israel. That decision was based on concerns about their use in violating international law. Pro-Palestinian groups hope this case will further pressure the government to meet its obligations under the UN Genocide Convention and international law.

Government’s Position

Dutch Foreign Minister Caspar Veldkamp stated that the Netherlands respects the ICC’s independence and complies with the Rome Statute. However, the government has yet to take significant action to halt arms exports to Israel.

This lawsuit highlights the growing global demand for accountability in conflicts involving international law violations. If successful, it could set a legal precedent, forcing other nations to reassess their roles in similar conflicts.
