Pakistan Gets Encouraging Response from China on Debt Reprofiling

Finance Minister Muhammad Aurangzeb said Pakistan is getting an “encouraging” response from China on its request to reprofile power sector debt. Speaking to Bloomberg at the IMF and World Bank meetings, he mentioned that discussions had started. So far, the response has been positive. However, he added that the talks are still in their early stages.

Aurangzeb stressed that Pakistan has gone through many financial programs and boom-and-bust cycles. Therefore, he emphasized the need to continue with structural reforms. He pointed out that the country has no other option but to move forward.

According to Bloomberg, this could give Pakistan some financial relief. Extending the debt maturities for power plants might help reduce electricity prices. Back in July, the finance minister had already started engaging with Chinese officials about debt reprofiling. These efforts were in line with the IMF’s proposed structural reforms.

In the same month, Pakistan agreed to a 37-month loan program with the IMF. However, this program was subject to timely financing assurances from Pakistan’s development and bilateral partners. So far, China has rolled over $16 billion of its debt. This is part of a total $26 billion for this fiscal year, which began in July.

Aurangzeb also mentioned plans to seek more financing from the IMF through its climate resiliency fund. However, the Chinese embassy in the U.S. did not confirm whether Beijing had responded positively to Pakistan’s request for loan extensions. Justice Yahya Afridi to Take Oath as Pakistan’s 30th Chief Justice

Justice Yahya Afridi will take oath as the Chief Justice of Pakistan (CJP) on Saturday. This comes after the Special Parliamentary Committee (SPC) nominated him last night. The current CJP, Qazi Faez Isa, will retire on October 25.

The 26th Amendment has changed how the chief justice is appointed. Now, the appointment is made based on the SPC’s recommendation. The recommendation must come from among the three most senior judges of the Supreme Court. Previously, the most senior judge automatically became the chief justice. Under this old rule, Justice Mansoor Ali Shah was expected to assume the position.

However, Justice Afridi is the third most senior judge after the incumbent CJP. Justice Munib Akhtar ranks as the second senior judge among those considered.

President Asif Ali Zardari has appointed Justice Afridi as the next chief justice. This was done under Article 175A, alongside Articles 177 and 179 of the Constitution. The Ministry of Law and Justice confirmed this appointment in a notification today. Justice Afridi will serve as the CJP for a three-year term starting from October 26. President Zardari also approved October 26 as the date for the oath ceremony, as reported by PTV News.

The Constitution provides a clause in Article 175A in case the nominated judge declines the role. If this happens, another judge from the remaining two nominees will be considered. If all three refuse, the next judge in line for seniority can be appointed.

Justice Yahya Afridi, born on January 23, 1965, will become the 30th Chief Justice of Pakistan. He became the youngest chief justice of the Peshawar High Court in December 2016. Later, in June 2018, he was promoted to the Supreme Court.

Information Minister Attaullah Tarar praised the transparent and democratic nomination process. He emphasized the importance of the parliament’s role in the decision. Tarar also noted that former CJP Saqib Nisar had not promoted Justice Afridi to the Supreme Court, even though Afridi was senior to both Justice Mansoor Ali Shah and Justice Munib Akhtar.

The Sindh Bar Council (SBC) welcomed the nomination. SBC Acting Secretary Rustam Bhutto described Justice Afridi as a man of character and wisdom. The council believes that Afridi’s understanding of law will ensure fairness and justice. They hope his appointment will bring positive changes to Pakistan’s judiciary.

The Special Parliamentary Committee’s decision came late on Tuesday night. The meeting took place at Parliament House. The SPC, formed on Monday by National Assembly Speaker Ayaz Sadiq, includes eight MNAs and four senators. These members were nominated by their respective party leaders.

Political parties from both the government and opposition have representation in the SPC. However, the PTI and its ally, the Sunni Ittehad Council (SIC), boycotted the meeting. They protested against the constitutional amendments that formed the SPC.

Despite the absence of PTI and SIC, nine members attended the meeting. Eight voted in favor of Justice Afridi. Only Kamran Murtaza of JUI-F supported Justice Mansoor Ali Shah.

Islamabad High Court Grants Bail to Bushra Bibi

The Islamabad High Court (IHC) granted bail to Bushra Bibi on Wednesday. She is the wife of PTI Chairman Imran Khan. The case involved an expensive Bulgari jewellery set from Toshakhana, which was obtained at a low price.

On October 4, Bushra Bibi filed a petition seeking post-arrest bail. The IHC notified the Federal Investigation Agency (FIA) regarding her petition. The prosecution claimed the jewellery set, valued at Rs71.5 million, was purchased by Imran Khan and Bushra for Rs2.9 million.

Justice Miangul Hassan Aurangzeb presided over the bail hearing. Bushra Bibi’s lawyer, Barrister Salman Safdar, and FIA prosecutor Umair Majid Malik were present. Malik presented his arguments, as Safdar had finished his remarks the day before.

During the hearing, Justice Aurangzeb mentioned Azerbaijan as an example. He noted that Azerbaijan keeps all state gifts in a museum. He also pointed out that a photo of Benazir Bhutto was displayed there, along with gifts from world leaders. Justice Aurangzeb questioned why Imran Khan was made an accused if Bushra did not submit the gifts. Malik responded that Imran held public office.

Comparison with Other Cases

Justice Aurangzeb compared the case with that of Justice Qazi Faez Isa. In Isa’s case, the husband was held accountable for his wife’s actions. However, Malik said Bushra’s case was different. He explained that state gifts must be declared and are state property until legally purchased. He emphasized that gifts cannot be retained before purchase.

Judge’s Remarks on Valuation

Justice Aurangzeb highlighted that Toshakhana gifts could only be valued correctly through an auction. He questioned how a gift’s value could be determined after it had been taken from the store. He granted Bushra Bibi bail on surety bonds worth Rs1 million. The court promised a detailed verdict later.

Separate Court Hearing

In another case, the FIA’s special court heard indictment proceedings against Imran and Bushra. The hearing was delayed once again. Judge Shahrukh Arjumand presided over the case. Due to security concerns, the hearing took place at the Judicial Complex in Islamabad instead of Adiala Jail. The court adjourned the hearing until October 26.

As the incumbent CJP Qazi Faez Isa prepares to retire on October 25, the government faces pressure to promptly appoint a new chief justice. Previously, the senior puisne judge, Justice Mansoor Ali Shah, would have automatically succeeded CJP Isa. However, the enactment of the controversial 26th Constitutional Amendment Bill has changed this process.

New Appointment Process Under 26th Amendment

Under the new amendments to clause 3 of Article 175A, the Special Parliamentary Committee will now appoint the CJP based on a recommendation from among the three most senior judges of the Supreme Court. This process requires a two-thirds majority vote.

The timeline for appointing the new chief justice is critical. The committee must complete the process within three days before CJP Isa’s retirement. According to clause 3C of Article 175A, the committee must send the nomination within 14 days prior to the CJP’s retirement. However, the first nomination under this clause after the commencement of the Constitution (Twenty-sixth) Act 2024 must be sent within three days before the retirement.

Should the nominated judge decline the position, the committee will consider the remaining two senior-most judges for nomination. As the deadline approaches, political tensions surrounding the appointment continue to escalate.

KARACHI: The Pakistan Stock Exchange (PSX) surged to a new all-time high on Tuesday, driven by strong post-26th Amendment gains. The KSE-100 index rose 409 points, or 0.48%, to close at 86,466, surpassing yesterday’s close of 86,057. Early in the day, the index reached a new peak, climbing 798 points to 86,846 during intraday trading.

The market continued its upward trend due to several positive factors. Analyst Ahsan Mehanti from Arif Habib Corp highlighted a $119 million current account surplus for September and a 48% year-on-year increase in foreign direct investment (FDI) for the first quarter of FY25. This increase amounted to $771 million. These economic indicators, especially the largest current account surplus since April 2024, fueled market optimism.

Notably, the surplus compared favorably with a $29 million surplus in August and a $218 million deficit in September 2023, according to data from the State Bank of Pakistan.

Following a period of cautious trading, the market received a significant boost after the enforcement of the 26th Amendment. This constitutional change brought an end to weeks of political uncertainty. The ruling coalition successfully passed the amendment, which limited the judiciary’s power to appoint the Chief Justice of Pakistan. Meanwhile, brokerage Arif Habib Limited (AHL) noted that the index continued to gain momentum as recent highs were exceeded. Among the key contributors to the market’s rise were Systems Limited, which gained 7.44%, Lucky Cement, which rose 2.61%, and Hub Power Company, which saw a 1.59% increase.

Investors are also considering disinflationary trends. According to AHL, October’s Consumer Price Index (CPI) is projected to increase by 6.3% year-on-year, significantly lower than the 28.48% inflation recorded in the same period last year. The average inflation rate for the first four months of FY25 now stands at 8.50%.

Market Outlook and Trading Volume

Despite the positive outlook, AHL cautioned that the KSE-30 index has yet to outperform its previous high from October 8, even as the KSE-100 index continues to set new records. The brokerage added that support for the KSE-100 has risen to 85,000 points, with further upward movement expected.

Out of 451 actively traded stocks, 241 saw gains, 149 declined, and 71 remained unchanged. K-Electric led the market with 224.204 million shares traded, followed by World Call Telecom with 30.203 million shares and Fauji Foods with 26.100 million shares. The total trading volume increased to 722.209 million shares, up from 474.949 million on Monday.

ISLAMABAD: Chief Justice of Pakistan (CJP) Qazi Faez Isa released a detailed minority judgment on Tuesday, stating that the Supreme Court’s July 12 verdict in the reserved seats case was not binding. He argued that the implementation of this verdict should be held off as the review petitions in the case are still pending and have not been scheduled for a hearing.

This note followed a second clarification by eight judges of the Supreme Court. They had reiterated that Parliament’s amendment to the Elections Act could not apply retroactively and could not reverse the court’s judgment on the reserved seats case. This move, however, displeased the Chief Justice, prompting his dissenting response.

In his detailed note, Justice Isa highlighted what he described as “constitutional violations and illegalities” in the majority’s short order from July 12, 2024, as well as in the detailed judgment issued on September 23, 2024. The committee, made up of both government and opposition members, convened in room no. 5. However, members from the Pakistan Tehreek-e-Insaf (PTI)-backed Sunni Ittehad Council (SIC) skipped the meeting. Their absence prompted another round of discussions later in the evening.

In response to SIC’s absence, the National Assembly Secretariat issued a statement confirming that SIC members had decided not to attend the meeting. Although a sub-committee was formed to convince them, which included Ahsan Iqbal, Rana Ansar, Raja Pervez Ashraf, and Kamran Murtaza, their efforts proved unsuccessful.

During this time, Barrister Gohar Ali Khan, representing SIC, reiterated that their decision to skip the session was in line with PTI’s political committee’s instructions. As a result, SIC lawmakers refused to participate.

Israeli Soldier Takes Own Life After PTSD from Gaza War

A 40-year-old father of four, Eliran Mizrahi, deployed to Gaza following the Israeli attack on the region on October 7, 2023. After six months in the war against Hamas, he returned home a changed man, traumatized by the horrors he witnessed. His family told CNN that Mizrahi struggled with post-traumatic stress disorder (PTSD) and felt deeply affected by his experiences. Tragically, before he was due to redeploy, he took his own life.

“He got out of Gaza, but Gaza did not get out of him. And he died after it, because of the post-trauma,” his mother, Jenny Mizrahi, said.

The Israeli military claims to provide care for thousands of soldiers suffering from PTSD and other mental health issues caused by the war. However, the exact number of soldiers who have taken their own lives remains unclear, as the Israel Defense Forces (IDF) has not released official statistics. Over the past year, Israel’s ongoing conflict in Gaza has resulted in the deaths of more than 42,000 people, according to health ministry figures in the strip. The United Nations reports that a significant portion of the casualties are women and children.

Many soldiers express fear about getting drafted into another conflict. An IDF medic who served in Gaza shared his concerns, stating, “A lot of us are very scared of getting drafted again to a war in Lebanon. A lot of us don’t trust the government right now.”

Israeli authorities have limited access to Gaza for foreign journalists, allowing them entry only with IDF escorts. This restriction makes it difficult to accurately report on the suffering of Palestinians and the experiences of soldiers. Israeli soldiers have described witnessing horrors that the outside world cannot fully understand. Mizrahi deployed to Gaza on October 8, 2022, tasked with operating a D-9 bulldozer, a heavily armored vehicle. Before his service, he worked as a manager at a construction company. After spending 186 days in Gaza, he sustained injuries to his knee and hearing damage in February due to a rocket-propelled grenade strike. After his return for treatment, doctors diagnosed him with PTSD in April, and he received weekly therapy. Unfortunately, his treatment proved ineffective.

“They didn’t know how to treat them,” Jenny Mizrahi said. “They saw things that were never seen in Israel.” During his leave, Mizrahi exhibited signs of anger, sweating, insomnia, and social withdrawal. He confided in his family that only those who had been with him in Gaza could comprehend his struggles.

“He always said, no one will understand what I saw,” his sister, Shir, told CNN. Jenny wondered if her son had killed someone during his service. “He saw a lot of people die. Maybe he even killed someone,” she said. “We don’t teach our children to do things like this. So, when he did this, something like this, maybe it was a shock for him.”

Guy Zaken, Mizrahi’s friend and fellow bulldozer operator, described the traumatic experiences they endured. “We saw very, very, very difficult things,” Zaken recalled. He testified to the Knesset about the psychological impact of their service, recounting instances where soldiers had to “run over terrorists, dead and alive, in the hundreds.”

Zaken also shared the lasting effects of these experiences on his daily life. He struggles to eat meat, as it reminds him of the gruesome scenes from Gaza, and he endures sleepless nights haunted by the sounds of explosions. “When you see a lot of meat outside, and blood… it really affects you,” he stated, referring to the bodies as “meat.”

PM Shehbaz Praises 26th Constitutional Amendment for Swift Justice

ISLAMABAD: After the successful legislation of the 26th Constitutional Amendment, Prime Minister Shehbaz Sharif praised the legal reforms. He stated that they will ensure swift redressal of cases pending with the judiciary.

Addressing his cabinet in Islamabad on Tuesday, the prime minister said, “With the 26th Constitutional Amendment, the people will get quick justice from the judicial system.” He congratulated his team for their efforts in passing the amendment, which he said would ease the judicial process for the common man.

He highlighted that the establishment of constitutional benches will help provide timely justice. “A long consultation with the ruling parties and those in the Opposition was held regarding the 26th Constitutional Amendment,” Shehbaz noted.

The prime minister’s comments came after the ruling coalition secured a two-thirds majority in both the Senate and the National Assembly to pass the amendment. The lower house voted with 225 votes in favor, while the upper house had 65 votes.

PTI’s Boycotted

The Pakistan Tehreek-e-Insaf (PTI) party boycotted the voting process, opposing the judicial reforms. Under the new law, the chief justice of Pakistan will be selected by a parliamentary committee and will serve a fixed three-year term. Following a late-night session that extended from Sunday into Monday, PM Shehbaz sent the amendment to President Asif Ali Zardari for his assent. Once signed, the bill became law, marking a significant shift in the country’s judicial structure.

Under the new system, the incumbent Chief Justice of Pakistan (CJP) Qazi Faez Isa, who is set to retire on October 25, will send the names of three senior judges to the parliamentary committee. This committee will then select the next CJP and forward the name to the prime minister, who will send it to the president for final approval.

At the cabinet meeting, PM Shehbaz described the reforms as a fulfillment of the Charter of Democracy, a vision first signed by Benazir Bhutto and Nawaz Sharif in 2006. He expressed optimism that the reforms will contribute to the country’s development and prosperity.

Sindh Government Sets Minimum Wage at Rs37,000 for Workers

KARACHI: The Sindh government has officially notified a new minimum wage of Rs37,000 per month for workers, effective from July 2024. sources reported the announcement on Tuesday.

According to the notification, all industrial and business firms in the province must comply with the new minimum wage standard. Employers are required to ensure their workers receive Rs37,000 monthly. The notification also clarified that workers already earning more than the minimum wage will not see any reduction in their pay.

The decision came after approval from Chief Minister Murad Ali Shah. The Sindh Minimum Wage Board had previously revised the wages for factory workers last year. Chairman of the board, Zulfiqar Ali Nizamani, had set the minimum wage at Rs33,280 for skilled workers and Rs32,000 for unskilled workers, with implementation starting from July 1, 2023.

Nizamani emphasized that factory owners must adhere to the new wage requirements, and any objections to the decision can be submitted within 14 days. He also warned that action will be taken against employers who fail to meet the minimum wage obligations.
