Three Provinces Sign National Fiscal Pact

The federal government, along with three provincial governments, has conditionally agreed on a new National Fiscal Pact (NFP). This pact fulfills a crucial requirement set by the International Monetary Fund (IMF). The agreement came after the Centre significantly modified the terms to address concerns raised by the provinces.

In a major concession to Sindh, any reduction in the size of the federal government will now be linked to consensus achieved through the Council of Common Interests (CCI). Officials reported that Punjab, Khyber Pakhtunkhwa, and Balochistan have conditionally agreed to the National Fiscal Pact, with Monday being the final day for all five governments to sign. However, no official confirmation has come from Sindh regarding their signing.

Existing NFC Framework

Under the existing NFC framework, provincial shares of federal taxes increased to 57.5%. Yet, the federal government still retained responsibilities related to provincial infrastructure, health, and education. Under the new pact, provincial governments will lose the ability to determine agricultural support prices. They must also amend agricultural income tax laws to raise taxes on small farmers to match federal personal income tax rates. The federal personal income tax can reach as high as 50%, while corporate rates stand at 29%.

It remains unclear if the IMF will accept the toned-down pact. The new agreement does not fully address expenditure issues concerning BISP and development projects. As part of its efforts to expand the tax base and reduce the federal expenditure burden, the IMF insisted that all five governments sign the NFP by September 30 and communicate it to the IMF headquarters the same day.

The NFP aims to replace the current NFC, which the government is hesitant to amend. There is a consensus between the military establishment and the federal government that the existing NFC leads to ongoing federal fiscal imbalance. While the government is eager to amend the Constitution for political gain, it shows reluctance to redefine the NFC for the economic viability of Pakistan.

Punjab and Sindh Raise Objections

Justice Munib Akhtar Protests Exclusion from Supreme Court Bench

Justice Munib Akhtar of the Supreme Court of Pakistan has protested against a decision by the Chief Justice-led bench to proceed without him. I cannot accept this.” He also expressed respect for the four judges who conducted the hearing but maintained that the decision to proceed without him violated legal procedures.

Justice Munib further explained that a five-member bench will hear the Civil Review Petition (CRP), as confirmed by an official note he received after the hearing. “The note confirms that five members heard the CRP. However, I did not participate, and the hearing proceeded with only four judges,” he wrote.

He added that the bench had space for five signatures, with his spot left blank. “This further confirms that the hearing should have involved all five members,” Justice Munib argued.

He also criticized the directive from the Chief Justice’s bench, stating it could not be considered a “judicial order.” He concluded by saying, “I must respectfully record my protest at what has been done. The direction in paragraph 4 of the order holds no legal consequence.”

Following Justice Munib’s dissent, Chief Justice Isa called a session of the Supreme Court’s Practice and Procedure Committee for Tuesday morning. The committee, formed under the SC Practice and Procedure Amendment Ordinance, had previously constituted nine larger benches to hear review petitions pending since 2018. Karachi Customs Directorate Uncovers Rs. 642.83 Million Tax Evasion

The Directorate of Intelligence and Investigation (I&I) – Customs, Karachi, has uncovered a significant tax evasion case worth Rs.642.83 million. The team detected this evasion during the scrutiny of a single Goods Declaration (GD) in September 2024. Led by Director Mian Masood Ahmed, Additional Director Afzaal Ahmad Wattoo, and Deputy Director Saif Ullah, the investigation took place under the guidance of Director General Ali Raza Hanjra from I&I-Customs, Islamabad.

The company involved, M/s. Enertech Water (Pvt) Ltd, Karachi, falsely claimed a sales tax exemption under Serial No. 22, Table-3 of the Sixth Schedule of the Sales Tax Act, 1990. This exemption applies only to projects with an Implementation Agreement with the Federal Government, which the importer did not have. Further investigations revealed that the exemption claim for customs duty under Serial No. 10, Part-I of the Fifth Schedule to the Customs Act, 1969, was also invalid.

Upon discovering these false claims, the Directorate immediately informed the Chief Collector of Customs Appraisement (South). This communication ensured that steps were taken to recover the evaded revenue. As a result, the Directorate successfully recovered Rs.462.83 million, marking the highest recovery from a single Goods Declaration in its history.

Another Case

The team’s efforts didn’t stop there. They also investigated another case involving the import of Solis brand grid-tied solar inverters with accessories. In this instance, the correct Valuation Ruling had not been applied. The Directorate recovered an additional Rs.77.97 million in duties and taxes from this case.

Altogether, the Directorate has recovered Rs.581.22 million in evaded taxes and duties in September 2024 alone. This accomplishment highlights their strong commitment to identifying loopholes in clearance processes and ensuring that all dues are collected properly.

The Directorate continues to work diligently to close any gaps in the customs system, preventing further tax evasion and securing legitimate revenue for the government. Court Rejects Bail Pleas of Imran Khan and Bushra Bibi in Toshakhana Case

According to the prosecutor, Imran Khan and Bushra Bibi received a Bulgari jewelry set, including a necklace and earrings, as a gift from Saudi Arabia during their visit in May 2021. The prosecutor told the court that the Ministry of Foreign Affairs valued the set at Rs71.5 million, but the couple had it privately valued at only Rs5.8 million.

The prosecutor further argued that the couple did not submit the jewelry to the Toshakhana repository, which stores gifts given to Pakistani officials by foreign dignitaries. Instead, they kept the items illegally. He requested that the court deny bail based on these violations.

On the other side, Barrister Salman Safdar, who represented Imran Khan and Bushra Bibi, argued that the new Toshakhana case mirrored the previous one. He claimed the allegations were the same, involving the same accusers, and should be dismissed. He also referred to the Supreme Court’s decision from September 6, which restored the NAB amendments, as grounds to end the case against his clients.

The court reserved its judgment after hearing both sides and announced its decision later in the day, rejecting the bail pleas of Imran Khan and Bushra Bibi.

The Jewelry Set Case

However, Imran Khan and his wife undervalued the set at Rs5.8 million and did not deposit it in the Toshakhana.

According to the FIA, this undervaluation caused the national treasury to lose approximately Rs30.28 million. Under Toshakhana rules, government officials can keep state gifts after paying a percentage of their value. However, the agency claims that the couple failed to comply with these rules.

The FIA argues that Imran Khan and Bushra Bibi violated the NAB Ordinance by illegally retaining these gifts. Imran Khan has remained in prison due to a series of legal challenges, including this Toshakhana case, the cipher case, and other charges related to the May 9 unrest.

Seven Labourers Shot Dead in Panjgur, Balochistan

QUETTA: An unidentified gunmen brutal attacked seven labourers in Panjgur district, Balochistan. The incident took place late Saturday night, according to police reports.

The victims, all hailing from Punjab, were residing in a house in the Khuda-i-Abadan area of Panjgur when the gunmen stormed in and opened fire. Seven men are killed, and one person is injured in the attack.
